The action was commenced May 27, 1950. The plaintiff, Harry Brown d/b/a Brown Window Cleaning Service, seeks an injunction
restraining defendants from picketing and otherwise interfering with him in the lawful pursuit of his business, which is a
sole proprietorship engaged in the window servicing business. Defendant, Robert Sucher is a business representative of the
Building Service Employees Union, and Marcus Silevitch is an employee of Don's Window Cleaning Company and a Union member.
Plaintiff alleges that there existed no labor dispute to warrant picketing, and that because of the malicious interference
of the defendants by picketing, plaintiff was injured. He also alleges that certain business firms refused to do business
with him because of said picketing. Defendants answered plaintiff's complaint with an affidavit alleging that in behalf of
the Union they were seeking to unionize workers in the window washing industry and that they had engaged in peaceful picketing
without restraint or coercion upon plaintiff. The motion for the injunction was heard, and an order temporarily restraining
defendants or their agents from the conduct complained of was granted June 5, 1950. From this order the defendants appeal,
on the grounds that there was a valid labor dispute, that no findings were made by the court, that plaintiff did not furnish
bond, and that in bringing the action plaintiff failed to comply with the statute requiring that residence of defendant be
